By accessing or using our website, engaging with our services, or participating in any training provided by Rimasys, you ("you" or "your") agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from using our website or services.
1. Services Provided
Rimasys Inc. offers medical imaging training services, including access to educational materials, specimen datasets, and training facilities. Our services are designed to enhance your understanding and proficiency in medical imaging through structured training programs. These services may include, but are not limited to, hands-on workshops, online training courses, and access to imaging specimens for educational purposes.
All training sessions and services will be described in detail in individual course materials, service agreements, or other official documentation provided at the time of booking or registration.
2. Eligibility and Account Creation
Eligibility: You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our services. If you are registering on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
Account Creation: To access certain services, you may be required to create an account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
3. Use of Services
Educational Purposes: All specimens, datasets, and training materials provided by Rimasys are intended for educational purposes only. You agree to use these materials solely for your personal, non-commercial training and development. Any use of training materials or specimens for commercial, diagnostic, or medical purposes is strictly prohibited.
Access to Facilities: In-person training may involve access to physical facilities, where you agree to adhere to all safety guidelines, rules, and regulations. Non-compliance with facility protocols may result in the suspension or termination of your access to the services.
4. Payment and Fees
Fee Structure: The pricing for Rimasys training services will be provided to you upon request or through specific service agreements. All fees are quoted based on the training program or service selected.
Payment Terms: Payment for services is required before the commencement of any training program unless otherwise agreed upon in writing. Payment methods and instructions will be outlined at the time of registration. Fees for services are non-refundable except as outlined in our cancellation policy.
Late Payments: If payment is not received by the due date, Rimasys reserves the right to suspend or cancel your participation in any training programs or services. Continued access may be reinstated upon receipt of payment.
5. Cancellation and Refunds
Cancellation by You: If you wish to cancel or reschedule your participation in a training program, you must notify Rimasys in writing according to the terms of our cancellation policy. Depending on the timing of your cancellation, you may be entitled to a partial refund, or a credit may be issued toward future training services. Please refer to the specific training program details for the applicable cancellation terms.
Cancellation by Us: Rimasys reserves the right to cancel or reschedule training sessions due to unforeseen circumstances. In such cases, we will provide you with a full refund or the option to reschedule the training at no additional cost.
Refund Policy: Refunds, if applicable, will be issued according to the specific terms set forth in the course or service agreement. Please review these terms at the time of booking.
6. Intellectual Property
Ownership of Content: All materials provided by Rimasys, including training content, specimen datasets, proprietary software, and related educational resources, are the intellectual property of Rimasys Inc. or its licensors. These materials are protected by copyright, trademark, and other intellectual property laws.
License to Use: Upon enrollment in a training program, you are granted a limited, non-exclusive, non-transferable license to access and use the training materials for the duration of the program. You may not reproduce, distribute, modify, or otherwise exploit the materials without prior written consent from Rimasys.
7. Confidentiality and Data Privacy
Rimasys respects your privacy and is committed to protecting your personal data. For information on how we collect, use, and safeguard your personal information, please refer to our Privacy Policy. You agree to the collection and use of your personal information as described in the Privacy Policy.
8. Limitation of Liability
No Warranties: Rimasys provides all training services and materials on an "as is" basis, and we make no representations or warranties regarding the completeness, accuracy, or availability of the services or materials. We do not guarantee that the training services will meet your specific needs or expectations.
Limitation of Liability: To the fullest extent permitted by law, Rimasys Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including, but not limited to, lost profits, data loss, or personal injury, even if Rimasys was advised of the possibility of such damages. Our total liability for any claim arising out of or relating to this Agreement shall be limited to the amount paid by you for the specific service at issue.
9. Indemnification
You agree to indemnify, defend, and hold harmless Rimasys Inc., its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including attorneys' fees) arising out of your use of the services, your violation of these Terms and Conditions, or your infringement of any third-party rights.
10. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Massachusetts, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be resolved through binding arbitration, in accordance with the rules of the American Arbitration Association, in Fall River, MA. The parties hereby waive their right to a trial by jury.
11. Modifications to Terms
Rimasys reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website, and the updated terms will be effective immediately upon posting. Your continued use of the services after such modifications constitutes your acceptance of the updated terms.
12. Termination of Services
Rimasys reserves the right to suspend or terminate your access to the services at any time, without notice, for violations of these Terms and Conditions or for any reason at our sole discretion. Upon termination, you will cease to have access to any training materials, specimens, or services provided by Rimasys.
13. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remainder of the provisions shall remain in full force and effect.
